Terms & Guidelines (Terms of Service)

1. Agreement
By using tharascent.com or purchasing from Thara (“we”, “us”, “Thara”), you agree to these Terms & Guidelines. If you do not agree, do not use the Site or purchase products.
2. Entity & Governing Law
Thara is brand under Thara Essentials Scent a Wyoming LLC. These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.
3. Eligibility
You must be at least 18 years old to purchase. By ordering, you represent you are legally able to form a binding contract.
4. Orders & Acceptance
Orders are subject to acceptance and availability.
We may refuse or cancel any order for any reason (suspected fraud, inventory, shipping restrictions).
Order confirmations are acknowledgements, not acceptance. Acceptance occurs when we ship.
5. Pricing & Payment
Prices are listed in USD. We may change prices at any time.
Payment is due at the time of order. We accept major credit cards and PayPal.
If payment is refused, we may cancel the order.
6. Shipping, Delivery & Risk of Loss
Products ship from U.S. warehouses. Delivery times are estimates.
Risk of loss passes to you upon delivery to the carrier.
For hazardous products (essential oils), we ship via carriers that accept regulated liquids; some carriers (e.g., USPS) are not used.
7. Sales Tax & Duties
Sales tax is charged where required by law. You are responsible for any import duties or customs fees on international orders.
8. Inventory & Fulfillment
We use third-party logistics/fulfillment partners. Inventory allocation and shipping are managed by our partners; we are not liable for delays caused by them except as otherwise required by law.
9. Product Safety & Use
Products are for external aromatic/home use only unless explicitly labeled otherwise.
Do not ingest products. Keep away from children and pets. Follow label instructions.
Do not make medical claims about essential oils. Consult a physician if pregnant, nursing, or under medical care.
10. Returns & Refunds
Our Refund Policy (above) governs returns and refunds. Please review it before purchasing.
11. Intellectual Property
All content on the Site (text, images, logos, product photos) is owned by Thara or licensed to Thara. You may not reproduce, sell, or use our intellectual property without express written permission.
12. User Conduct
You agree not to use the Site for unlawful purposes, not to post false information, and not to interfere with Site operation.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THARA PROVIDES PRODUCTS AND THE SITE AS IS AND AS AVAILABLE. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
14. Limitation of Liability
IN NO EVENT WILL THARA, ITS OFFICERS, OR AFFILIATES BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR PRODUCTS IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold Thara harmless from any claim, loss, liability, or expense arising from your breach of these Terms, misuse of products, or violation of law.
16. Recalls & Safety Notices
If a safety issue arises, we will notify affected customers and provide instructions (including returns, refunds, or replacements) as required.
17. Termination
We may suspend or terminate access for violation of these Terms. Termination does not limit other remedies.
18. Modifications
We may update these Terms; changes are effective when posted. Continued use after changes means you accept them.
19. Dispute Resolution
Any dispute will be governed by Wyoming law. Parties agree to resolve disputes by binding arbitration in Wyoming, except where prohibited by law. You and Thara each waive trial by jury.
20. Severability
If any provision is invalid, the remainder remains in effect.
